Employer Sponsorship: The applicant should secure a job offer from a US Employer. If an US Employer sponsors you, then the employer must file a petition with USCIS.
H-1B Petition Filing: The employer files the petition through Form I-129 and the documents need for that includes:
- Evidence which shows that an employee has a speciality occupation and that employee can perform that employment.
- A copy of official permission or licence for the proposed employee that they can perform occupation.
- Written contract copy between the employer and the proposed employee.

Visa Application: The proposed employee needs to complete the DS-160 Form. This form is the electronic visa application. For the application, the applicant needs to go to www.ceac.state.gov/genniv. The applicant needs to select a country as India and select the embassy location as per your preference. The personal information, travel information, travel companions, previous US History, Address and Phone number, Passport, US Contact, Family, Work, Security and background information need to be filled, reviewed and submitted.
